1. TERMS OF USE

    By downloading, browsing, accessing or using this MyHome, you agree to be bound by these Terms and Conditions. MyHome App reserves the right to amend these terms and conditions any time. If you disagree with any of these Terms and Conditions, you must immediately discontinue your access and your use of the services offered by this application. Continued use of MyHome will constitute acceptance of these Terms and Conditions, as may be amended from time to time.
  2. PERMITTED USE

    1. You are granted a non-exclusive, non-transferable, revocable license to:
      a. access and use MyHome strictly in accordance with these Terms and Conditions;
      b. use MyHome solely for internal, personal, non-commercial purposes; and
      c. to print out discrete information from MyHome solely for internal, personal, non-commercial purposes and provided that you maintain all copyright and other policies contained therein.
    2. You may not copy, store either in hard copy or in electronic format, transmit, transfer, perform, broadcast, publish, reproduce, display, distribute, sell, license, rent, or lease any of the contents of MyHome to any third person, including others in your company or organization, whether for direct commercial or monetary gain or otherwise without prior written consent of MyHome App or its third party provider.
    3. Certain portions of MyHome are limited to registered users and/or allow a user to request services online from the Property Management Office by entering personal information. You agree that any information you will provide will be complete and accurate.
    4. When using MyHome to request for services, you agree that you will not attempt to enter offensive or derogatory words or statements.
    5. You are responsible to prevent unauthorized use of your MyHome account. You are entirely responsible for maintaining the confidentiality of your account and password. Furthermore, you are entirely responsible for any and all activities that occur under your account.
    6. You agree to notify the Property Management Office immediately of any unauthorized use of your account or any other breach of security. The Property Management Office nor MyHome App will not be liable for any loss that you may incur as a result of someone else using your account, either with or without your knowledge. However, you could be held liable for losses incurred by the Property Management Office or MyHome App or another party due to someone else using your account. You may not use anyone else's account any time, without the permission of the account holder.
  3. FORMS AND DOCUMENTS

    1. MyHome App may make available through MyHome forms, checklists and other documents (collectively, “Documents”) that can be used in your transactions with the Property Management Office. All Documents are provided on a non-exclusive right basis only for your personal use for non-commercial purposes, without any right to re-license, sublicense, distribute, assign or transfer such license. Documents are provided for free and without any representations or warranties, express or implied, as to their suitability, legal effect, completeness, modernity, accuracy, and/or appropriateness.
    2. If the Documents on the Property Management Office’s printed documents differ from the information contained on MyHome, the information on the Property Management Office’s printed documents will take precedence.
  4. ERRORS, CORRECTIONS AND CHANGES

    MyHome App does not represent or warrant that MyHome will be error-free, free of viruses or other harmful components, or that defects will be corrected. MyHome App may make changes to the features, functionality or content of MyHome any time without any notification in advance. MyHome App reserves the right in its sole discretion to edit or delete any documents, information or other content appearing on MyHome.
  5. THIRD PARTY CONTENTS AND WEBSITES

    1. Third party content from partner merchants may appear on MyHome and may be accessible via links. MyHome App and the Property Management Office are not responsible for and assume no liability for any mistakes, misstatements of law, defamation, omissions, falsehood in the statements, opinions, representations or any other form of content thereon. MyHome App and the Property Management Office are not liable for any damages or loss arising from access to those websites. Use of the hyperlinks and access to such linked websites are entirely at your own risk. You understand that the information and opinions in the third party content represent solely the thoughts of the merchant and is neither endorsed by nor does it necessarily reflect MyHome App and the Property Management Office’s belief.
    2. Once you access third party websites to leave MyHome, please note that MyHome App and the Property Management Office do not have any control over that other website. Therefore, MyHome App and the Property Management Office cannot be held responsible for the protection and privacy of any personal information which you provide whilst visiting such site.
  6. DATA PRIVACY POLICY

    MyHome App and the Property Management Office are committed to ensuring that your personal information are protected and secured. Should we ask you to provide certain information, by which you can be identified, you can be assured that it will only be used in accordance with the Terms and Conditions herein and this Data Privacy Policy.

    By using MyHome, you consent to the processing of your personal information in accordance with this Data Privacy Policy. You have the right to request for a copy of any personal data from MyHome App and the Property Management Office hold about you, and have it corrected if you think it is inaccurate or incomplete. If you wish to request to do so, please reach out to the Property Management Office personnel who will respond to your request and execute the corresponding corrections or changes of any information.

    MyHome App adheres to the Data Privacy Act of 2012 and its Implementing Rules and Regulations. In particular, it:

    1. Shall collect personal and sensitive personal information ranging from name, age, and address, to government issued IDs from the Property Management Office thru physical and/or digital means for the processing of requests made through MyHome.
    2. has appointed information asset custodians to ensure that your data is properly handled and kept secure, in accordance with data privacy laws, and industry approved standards.
    3. shall keep your personal data for ___ years from date of transaction unless the law requires a longer period. At the end of the retention period, your personal data shall be deleted and made unrecoverable using approved secure disposal methods (e.g. data sanitization, secure shredding). This includes physical media (e.g. printed, removable media, back-up tapes, etc.).
    4. is an advocate of your rights under the data privacy law. These are the rights to information, access, data portability, rectification, erasure or blocking, as well as to object, to file a complaint, and to indemnification.
    5. shall update this privacy policy and its practices regularly to reflect changes in applicable laws, government and regulatory requirements, technological, industry and business practices. We may notify you on these changes whenever applicable.
  7. USE OF PERSONAL INTORMATION

    MyHome App and the Property Management Office may use and process your Personal Data for the following purposes:

    a. to create, administer and update your account;:
    b. to fill up a user profile or registration forms;
    c. to verify and process your requests with the Property Management Office;
    d. to perform internal operations including troubleshooting software bugs and operational problems, conducting data analysis, testing and research, monitoring and analysing usage and activity trends;
    e. to send you alerts, newsletters, updates, billings, promotional materials; and notify, invite and manage your participation in the community events or activities;
    f. to comply with court orders or other legal, governmental or regulatory requirements;
    g. to enforce these Terms and Conditions or other agreements; and,
    h. to protect MyHome App and the Property Management Office’s rights or property in the event of a claim or dispute.
  8. SECURITY BREACH MANAGEMENT

    1. In the event that a user becomes aware of any suspected or actual breach of Personal Data, he shall promptly notify and provide information to MyHome App or the Property Management Office of the breach.
    2. MyHome App shall then take reasonable steps to mitigate the effects and to minimize any damage resulting from the Personal Data breach, and it shall update the user on the measures taken to address the Security Breach, with the following details:
      a. description of the measures taken or proposed to be taken to address, resolve, mitigate, contain, manage or limit the consequences of the Security Breach;
      b. actions being taken to secure or recover the Personal Data that were affected; and
      c. measures being taken to prevent a recurrence of the security breach; and
      d. such other additional information required by the Discloser.
    3. All parties shall cooperate with each other in the investigation of any breach of Personal Data, including any litigation against third parties which may be deemed necessary to protect Personal Data.
  9. INDEMNIFICATION

    You agree to indemnify, defend and hold MyHome App and the Property Management Office and their partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, advertisers, product and service providers, and affiliates harmless from any liability, loss, claim and expense related to your violation of these Terms and Conditions or use of MyHome.
